There has been concern from healthcare providers in providing information to schools without parent/guardian permission. Healthcare providers function under the Health Insurance Portability and Accountability Act (HIPAA) while schools function primarily under the Family Educational Rights and Privacy Act (FERPA). The U.S. Departments of Education and Health and Human Services published Joint Guidance on the Application of FERPA and HIPAA to Student Records.
This guidance explains the relationship between FERPA and HIPAA and addresses the confusion on how these two laws apply to student records.
